Learning Era LLC (“Company,” “we,” “our,” and/or “us”), a Washington limited liability company, understands the importance of protecting your privacy and strives to treat your personal data according to applicable laws that regulate securing the access, maintenance and transfer of personal data. This Privacy Policy (“Policy”) describes the types of information we may collect from you or that you may provide when you visit our website ( “Website” ), mobile applications (“Apps”), dashboards, and related services (collectively, our “Service”), and our practices for collecting, using, processing and re-disclosing that information. This Policy applies to Learning Era’s products and services, including Pictoword School, its related parent and teacher dashboards, Vivana.ai, and Suredeals.ai.

By using our Service, you acknowledge this Policy and agree to be bound by the disclosures and terms of this Policy, to the extent permitted by applicable law.

Information Collected (“Information”) Information We Collect Directly From You

When you use our Service, we may collect information that you provide directly to us. For certain educational services, such as Pictoword School, an educator, school, or parent may choose to create an account to personalize learning for individual children and to monitor their progress (“Account Holder”). When creating such an account, we will ask you to provide your name, your child's name, support language, your email address, a password, your role (e.g., teacher, math specialist, parent, etc.), grade(s) taught, if applicable, and your school's name and address, information which we use to provide the Service and authenticate an educator.

For users of AI-enabled services such as Vivana.ai, we may also collect the information you submit through the App, such as text prompts, messages, uploaded files, PDFs, images, audio or voice inputs where available, saved drafts, chat history, and other content you choose to submit in connection with your use of the Service.

For users of AI-enabled services such as SureDeals.ai, we may collect information such as account details, saved preferences, searches, saved items, alerts, support requests, and other information you choose to provide in connection with your use of the Service.

Information Collected Automatically

When you use our Service, we may collect certain information automatically from your device. Specifically, the information we collect automatically may include information like your IP address, device type, browser-type, device identifiers, broad geographic location (e.g. country or city-level location), and other technical information. We may also collect information about how your device has interacted with our Service, including the pages accessed, features used, links clicked, product interaction data, crash data, performance data, and similar usage, analytics, diagnostic, advertising, or measurement information, depending on the product and your device settings.

For users of our Service that use AI, we ask for and process the text, prompts, messages, files, images, audio, and other content you enter, upload, attach, or send to the App, as well as any text or, other content generated by AI via the App (“User Content”). This information is necessary for the adequate performance of the contract between you and us. Without such information, it may be impossible to provide complete functionality of the App and perform the requested services.

Subject to your compliance with certain rules and restrictions outlined in our Terms of Use, you may dispose of, use, share, or otherwise exploit your User Content for your own purposes. However, any use of User Content is at your sole risk, i. e. you assume and bear all risks and responsibility associated with your use of User Content. It is your sole responsibility to ensure compliance with the applicable laws while using the User Content.

Please note that we engage third party service providers, including Open AI, L.L.C., for the purpose of processing User Content and generating AI-enabled outputs. If you choose to use features that obtain information from the Internet, including “Ask the Web” or similar features, your Input Content will be processed by our third-party service providers including Microsoft Corporation and Google LLC, for the purposes of obtaining Internet search results pertinent to your Input Content and updating your Output Content accordingly.

We may also use third-party service providers to support hosting, analytics, diagnostics, authentication, payments, subscriptions, customer support, advertising, attribution, or other operational functions of the Service. Depending on the product, we may share information with schools, educators, parents, or guardians where relevant to providing the Service.

Information Uses & Processing

Learning Era collects and processes Information for the following purposes:

  • To allow us to respond to inquiries and requests;
  • To allow us to process an event registration form;
  • To allow us to provide you with a more personalized experience on our Service;
  • To provide customer support;
  • To perform our contractual obligations for you;
  • To comply with legal obligations;
  • To provide educational features, progress tracking, personalization, adaptive learning, and related parent, teacher, school, or administrator dashboard functions for educational services such as Pictoword School;
  • To provide AI-enabled features, including responses, summaries, generated content, saved chats, saved drafts, voice-based interactions, and similar features made available through services such as Vivana.ai;
  • To provide commerce, search, recommendation, price, availability, alert, saved item, and verification features for other Learning Era services;
  • To maintain, improve, analyze, secure, troubleshoot, diagnose, and protect the Service;
Payments and Subscriptions

If you purchase or subscribe to any paid features, services, or plans, payment information may be collected and processed by the applicable payment processor or app store provider and not directly by Learning Era, except for billing, transaction, subscription, purchase history, and related account information that we may receive or maintain as needed to provide the Service, manage subscriptions, provide support, maintain records, and comply with legal obligations.

Right to Erasure & Data Portability

You can: (i) object to processing of your Information that is personally identifiable (“Personal Information”), (ii) request that we restrict processing of Personal Information; (iii) request portability of your Personal Information; and/or (iv) request access to, correction of, or deletion of your Personal Information, subject to applicable law. Also, if we have collected and processed your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent. For student accounts or accounts associated with a school, classroom, family account, or educational dashboard, requests relating to access, correction, or deletion may need to be made by the applicable parent, guardian, educator, school, or district administrator, as appropriate.

Choice to Opt Out

You have the right to opt out of marketing communications we send at any time. If you no longer wish to receive electronic newsletters or other communications, you may modify your preferences or remove yourself from Learning Era email lists by emailing us at  support@learningera.com .

Children

Some parts of our Service, such as Pictoword School, are designed for use in educational settings and may be used by children under the age of 13 under the direction of a parent, teacher, school, or school district. In connection with such educational services, we may collect Personal Information relating to student users as authorized by the applicable parent, educator, school, or school district in order to create and manage accounts, provide educational activities, personalize instruction, track progress, support parent and teacher dashboards, maintain the Service, and provide related support, security, and operational functions.

For other parts of our Service that are not directed to children, we do not knowingly collect Personal Information online from children under the age of 13 without appropriate authorization. The Service is intended for use by those in the fields of education, businesses and other adults. We request that children under the age of 13 do not submit any Personal Information to us. If we learn that we have collected or received Personal Information from a child under 13, in a manner not permitted by applicable law, we will take steps to delete that information.

Social Media

We use third party social media sites to provide Learning Era content in formats that may be useful or interesting; however, the Website and other official Learning Era product pages are the official sources of information about products and services from Learning Era LLC. Learning Era LLC cannot attest to the accuracy or usage of other information provided by these or any other linked sites.

As with many other sites, our Service may use “cookies” or other technologies to help us deliver content specific to your interests, to process your requests, and/or to analyze your visiting patterns.
